real estate questions ?

Nestor Klan: He cant but if he is a smooth talker he will make you think so. If she never filed it then the house is still his but there is a good chance the bank wont sell it to him. The lean for 6400 is just a lean and is paid for by the seller on the closing date by the attny. Just be careful as this guy will try to make your life hell if he wants it bad enough.

Katheryn Skrobacki: We are cashing buyers and the wife is selling it as "sold buy owner" the husband hasnt has anything to do with her since the div! orce and the woman will not sell it to him. she told us point blank that she will let him get it. we are not going through a realtor. we have a realesta attorney though. thanks.

Julieta Suleiman: There are many issues that have to be resolved here. First question is did the man ever sign the note to the house? If he did, his name would be drug through the foreclosure as well, if a refinance was never completed, he's still on the note and this mortgage is still showing on his credit. The deed that was signed in 98 may or not be recordable, (depending on state laws, a letter may have to accompany the deed explaining why it took 10 years to record the deed) thus if this house is sold, he will have to sign off on a new deed to do so. My next question is this, do you know if this guy put some kind of lien on the property for 6400. I could assume that the other papers he signed were a buyout agreement, but I have never seen that shown as a lien, maybe though as I don't! know the state the property resides in. If this guy is not o! n the note, then he may be correct in waiting for the house to go into foreclosure, and yes, he can do this, he's not being the nicest guy in the world, but he may be able to pull this off. My best advise at this point would be for the woman to seek legal counsel as my question is can the man actually refuse to be paid the 6400? Depending on the state and possible buyout agreement, this may be the way to attack the problem. Also bring up the deed with legal counsel as if you can get that deed recorded, this would take him off of title and the question would become is he a note holder, if not, then he has no interest in the property, but get with an attorney asap...Show more
